First Reading of Proposed Parking Ordinance & Public Hearing

The Board of County Commissioners will hold a first reading and public hearing on the proposed ordinance regulating parking on public roads in unincorporated Larimer County.

Community members may attend the hearing and provide public comment either in person or virtually. Additional options are available for those who would like to provide feedback outside of the hearing.

The Board will hear public comment and consider the proposed ordinance. The ordinance has not been adopted, and no final decision has been made.

Background

About the Proposed Parking Ordinance

Larimer County is moving forward with a proposed ordinance to address concerns related to parking on public roads in unincorporated Larimer County.

The ordinance would:

• Establish parking regulations for abandoned and inoperable vehicles on County public roads

• Establish a civil enforcement process, not a criminal process

• Create a structured approach for notice, compliance and, when necessary, removal of vehicles

Why is this ordinance being considered?

This proposal is being considered in response to ongoing concerns from community members and public safety partners related to:

• Access and safety

• Impacts on neighborhoods and shared spaces

• Challenges associated with  prolonged vehicle parking on public roads

The County also recognizes that parking enforcement may affect people who are living in their vehicles and may be experiencing homelessness. The proposed ordinance is intended to provide a legal framework that allows the Sheriff’s Office to address parking concerns while prioritizing connections to available resources and services when appropriate.

Homelessness and housing instability are complex, community-wide issues. This ordinance is one potential tool under consideration and does not represent the full scope of ongoing efforts to address those challenges.

How Has the Proposal Changed?

Based on community feedback and further review, the Board of County Commissioners narrowed and revised the original draft proposal. The current proposed ordinance focuses only on parking on public roads in unincorporated Larimer County.

Key changes include:

• Camping provisions were removed. The current proposal does not include the previous restrictions on camping or temporary structures.

• The ordinance now focuses on abandoned and inoperable vehicles. These are the parking violations addressed by the proposed ordinance.

• The definition of an abandoned vehicle was revised. A vehicle is generally considered abandoned when it remains in one location on a County public road for more than 72 hours. Moving the vehicle less than 700 feet does not restart that time period.

• An exception was added for certain vehicles parked near the registered owner’s property. An operable vehicle with current license and registration is not considered abandoned when parked within 700 feet, as measured along County public roads, of its registered address in unincorporated Larimer County.

• Penalties were significantly reduced and clarified. The current proposal establishes civil fines of $10 for a first offense, $20 for a second offense within 30 days, and $30 for third and subsequent offenses within 60 days.

• Definitions and terminology were simplified and clarified to better define where the ordinance applies and how it would be enforced.
