Legislative Session Highlights
The 88th Texas Legislative session ended May 29, 2023. Out of 167 bills tracked by DSD, 21 bills cleared both chambers and were sent for signature to the Governor.
- HB 2127, also known as the "super preemption bill," would prohibit the City from creating and enforcing rules or ordinances if the State of Texas already establishes regulations on that subject. Signed by the Governor on Jun. 14, the bill becomes effective on Sept. 1, 2023. The City Attorney's Office is analyzing all potential impacts of this bill.
- SB 929 is for city initiated rezoning only. The bill requires the city to send additional notices, including language clearly stating a hearing on a rezoning may be held and that such hearing could result in loss of the right to operate property for the current use (only if the city initiated zoning results in non-conforming uses). The bill was signed May 19 and is in effect as of Jun. 1, 2023.
- HB 3526 prohibits the city from applying municipal level building codes to solar pergolas. This bill was signed Jun. 2 and becomes effective Sept. 1, 2023.
- SB 2038 requires release from the Extraterritorial Jurisdiction (ETJ) if a majority petition is delivered to the City Clark. City of San Antonio added language to this bill to exempt areas within 15 miles of a federal military installation. Bill was signed May 19 and becomes effective Sept. 1, 2023.
- HB 3699 is related to procedures for the city to request right-of-way dedications. The Governor signed the bill Jun. 18 and will become effective Sept. 1, 2023. Be on the lookout for an Information Bulletin (IB) on this topic.
New Information Bulletins (IB) or Rule Interpretation Determinations (RID) will be issued to account for mandated changes; please be on the lookout for these.

Budget Update
The proposed FY 2024 DSD budget is one step closer to being presented to the City Council. The DSD Leadership team met with City Manager Erik Walsh on June 16, and thanks to the dedication and hard work of our staff, we reported that the department is on track to meet our major performance measures. This year we are not requesting any major changes in the DSD budget, and City Manager Erik Walsh thanked the team for their hard work. Upcoming key dates for the budget development process are as follows:
- August 10 – City Manager Presents the Proposed Budget to City Council
- August 14 to September 13 – Budget Work Sessions
- September 14 – Budget adoption by Council

Successful Start to SABCA Summer Sessions
DSD's Support Services staff hosted the first summer 2023 Summer sessions of the San Antonio Building Codes Academy (SABCA) on Jun. 14-15, focusing on the 2021 International Energy Conservation Code (IECC) Essentials. A total of 163 staff and customers attended during the 2-day training given by Shirley Ellis, International Code Council (ICC) Board Member, where she shared her expertise in the energy conservation.
A second set of courses will be scheduled for Aug. 3-4, focusing on the 2021 International Residential Code (IRC) Wood Wall Bracing.
Starting out the new fiscal year on Oct. 17-20, training courses will be offered on the International Mechanical Code (IMC) Mechanical Plan Review and Inspections and Legal Aspects of Administration. Both will be offered by ICC instructors. Stay tuned as we finalize all details.
All SABCA sessions are at the City’s Hardberger Park, Urban Ecology Center, located at 8400 NW Military Highway. ICC instructors deliver excellent training to provide our staff and customers with better understanding of topics important to the development community.
SABCA was established with the goal of bringing high-quality educators and necessary building-related codes training to code officials, design professionals, builders, tradesmen and building owners and managers.

The Zoning Commission meeting scheduled for July 4, 2023 is CANCELLED. The next regularly scheduled meeting will be Tuesday, July 18, 2023.
