Flood Hazard Areas Effective Date (TC-4-22)
Flood Hazard Areas Effective Date (TC-4-22): This text change proposes amending dates intended to be the effective date of TC-16-20 referenced within the body of Ordinance No. 2021 – 231 TC 447, adopting TC-16-20 Special Flood Hazard Area Regulations (“TC-16-20”). Background information: During the approval of TC-16-20, which upon being effective will prohibit any new development on vacant properties within the FEMA 100-year floodplain, the City Council set the effective date as April 1, 2022. This date was selected assuming the FEMA preliminary maps would be effective by that date. With the new FEMA maps effective date being July 19, 2022, Staff recommended changing the effective date of TC-16-20 to July 19, 2022, so the ordinance change will coincide with the map adoption. On March 1, 2022, City Council delayed the effective date of TC-16-20 from April 1, 2022, to July 19, 2022. Because “April 1, 2022” meaning the effective date of TC-16-20 appears several times in the body of TC-16-20, Council authorized this text change correcting these references to “April 1, 2022” in the body of TC-16-20.
Current Rules: Because this text change amends an ordinance that has yet to take effect, should the current version of TC-16-20 take effect without adoption of TC-4-22, several references to the effective date would be in error and pre-date the effective date of the original text change and adoption of the flood maps.
Proposed Text Change: The proposed text change deletes all references to the date of “April 1, 2022” found in Section 1 of TC-16-20 and inserts in lieu thereof the date of “July 19, 2022.”
Public Meeting Schedule: This text change is scheduled for the Planning Commission meeting on April 12, 2022. The Commission may act on that date or refer to their Text Change Committee for further discussion. We will be collecting comments here through April 1, 2022.
