The request would increase the maximum building height from three stories to five stories and prohibit some uses normally permitted in CX-.
Existing Zoning: CX-3-PL and CX-3-CU
The existing zoning is Commercial Mixed Use-3 Stories-Parking Limited Frontage (CX-3-PL), and Commercial Mixed Use- 3 Stories with zoning conditions (CX-3-CU). The existing zoning conditions apply to a portion of 6250 Glenwood Ave and 3917, 4001 Pleasant Valley Rd. They exist as follows:
There will be a transitional protective yard Type A adjacent to the residential properties along the eastern boundary, adjacent to Parcels 83, 367 and 895, Tax Map 377. This transitional protective yard will be no less than fifty (50) feet in width.
The subject property will not be utilized for dwellings, congregate care, or congregate living structures.
Maximum building height for entire property to be three stories (36 feet).
A fifty (50) foot protective yard meeting the landscaping requirements for a fifty (50) foot Thoroughfare yard shall be provided along the entire frontage along Pleasant Valley Road.
A tree inventory and preservation plan to protect and preserve trees five (5) inches or more in caliper shall be submitted to the City of Raleigh at site plan approval submission.
Upon development of new building area or modification increasing gross building area of existing buildings, the development shall comply with CR 7107.
Proposed Zoning: CX-5-PL-CU
The existing zoning is Commercial Mixed Use-5 Stories-Parking Limited Frontage- with zoning conditions (CX-5-PL-CU). See UDO Section 3.1 for more details on Mixed Use Districts. See UDO Section 3.4 for more information on frontages. The proposed zoning conditions are as follows:
The following Principal Uses as listed in UDO Section 6.1.4. that are permitted, limited or special uses in the CX- district shall be prohibited: (i) Adult establishment; and (ii) Detention center, jail, prison.
