5200 Hillsborough St Assemblage (Z-34-22)
This requested rezoning would allow retail uses and services on the parcels currently zoned for residential only, increase the allowable height from 3 to 5 stories and change the frontage from Parking Limited to Urban Limited, which prohibits parking between the building and the right of way. The propsed conditions prohibit certain uses otherwise allowed in neighborhood mixed-use districts and limit the location of non-residential uses.
- Existing Zoning: R-10 and NX-3-PL
- The existing zoning is Residential-10 (R-10) and Neighborhood Mixed-Use 3 stories (NX-3) with Parking Limited frontage (PL).
- Proposed Zoning: NX-5-UL-CU
- The proposed zoning is Neighborhood Mixed-Use 5 stories (NX-5) with Urban Limited frontage (UL) and conditions (CU). UDO Section 3.1 details mixed-use districts. UDO Section 3.4 details frontage types.
- The proposed conditions are:
The following Principal Uses as listed in UDO Section 6.1.4. that are permitted, limited, or special uses in the NX- district shall be prohibited: (i) Outdoor sports and entertainment facility (>250 seats); (ii) Shopping Center; (iii) Vehicle Fuel Sales; (iv) Vehicle Sales/Rental; (v) Detention center, jail, prison; (vi) Vehicle repair (minor)
Nonresidential uses shall be only be permitted within 120' of the Hillsborough Street right-of-way.
