This rezoning request would modify the conditions of an existing zoning district. The existing district allows office development and a small amount of retail. The existing zoning conditions limit height to 36 feet and allow only one residential unit to be constructed. The proposed modifications would change the height limit to 50 feet and allow as many as 36 residential units.

  • The existing zoning is Office Mixed-Use with a 3-story height limit, zoning conditions, and Special Highway Overlay District-2 (OX-3-CU w/SHOD-2). See UDO Section 3.1 for more details on mixed-use districts and UDO Section 5.3 for more details on the Special Highway Overlay District-2.
• Proposed Zoning: CX-3-CU (amend zoning conditions)
  • The proposed zoning district will amend the zoning conditions to:
    • Remove the limit of 1 dwelling unit.
    • Remove the height maximum (underlying 3-story and 50 foot limit would still apply.
    • Change the uses that are prohibited.
  • The following zoning conditions will remain:
    • Development shall comply with the provisions of CR-7107 of the Raleigh Planning Commission Calulations for this provision shall be based on a zoning change from Rural Residential (RR)
    • Reimbursement for future right-of-way dedications shall be based on RR values.
