The applicant proposes to rezone these parcels to allow a mixed-use development. Non-residential uses up to 4 stories in height would only be permitted within 500 feet of Capital Boulevard. Maximum residential building height is limited to 3 stories or no more than 50 feet. The apartment building type will be prohibited.

Proposed Zoning Conditions:
1. The portion of the subject property that is north of Perry Creek shall be subject to following standards:
Non-residential uses shall only be permitted within 500 feet of the Capital Boulevard (U.S. 1) right-of-way. Within this 500' zone, the maximum building height shall be 4 stories or 68 feet.
Permitted residential uses shall be limited to single-unit living, two-unit living, multi-unit living and accessory uses.
The apartment building type shall be prohibited.
The maximum residential building height shall be 3 stories or 50 feet.
2. The 100-year Floodplain shall remain undisturbed from added fill except for the installation of streets, sidewalks, utilities, stormwater conveyances, greenway trails, fencing, or other public improvements.
