Vehicle Fuel Sales Use Standards (TC-13-21)
Vehicle Fuel Sales Use Standards (TC-13-21): This text change proposes amending the Unified Development Ordinance (UDO) to modify the use standards for Vehicle Fuel Sales in the NX-, CX-, DX- and IX- Districts. Read the full draft ordinance.
Background information:
This text change was initiated by a member of the public and was authorized by the City Council at their August 17, 2021 meeting.
Current Rules:
UDO Section 6.4.11.C.4. states that a Type 2 Protective Yard is required when a property zoned NX-, CX-, DX- or IX- contains a Vehicle Fuel Sales Use and abuts a Residential district or residential use. The general standards for a Type 2 Protective Yard as set forth in UDO Article 3.5 Neighborhood Transitions are as follows:
- Average Width - 20 feet
- Screening - A wall or fence between 6.5 and 9 feet in height.
- Landscaping - Five shade trees per 100 lineal feet; four understory trees per 100 lineal feet; and 30 shrubs per 100 lineal feet.
Unlike other uses, Vehicle Fuel Sales must be screened with a wall a minimum of 6.5 feet in height. A fence cannot be used to satisfy this requirement.
Proposed Text Change:
Under the proposed changes, a Type 2 Protective Yard would only be required when a fuel pump island is located within 100 feet of a Residential district or use. All other requirements would remain the same.
Public Meeting Schedule:
This text change is scheduled for a Planning Commission meeting in September. The Commission may act on that date or refer to their Text Change Committee for further discussion.
