Play Structures (TC-17-21): This text change proposes to modify the existing regulations for accessory structures to exempt certain minor structures from setbacks and permitting requirements. Read the full draft ordinance online.
Background information:
The City’s Unified Development Ordinance (UDO) categorizes most buildings and structures on any given lot into two categories and applies separate rules to each: Principal Structures and Accessory
Structures. Principal buildings and structures contain the primary function or activity on the lot (e.g. – the house on a single-family lot). Accessory structures are those that are smaller and serve an ancillary purpose to the principal building (e.g.- a detached garage or shed). The UDO provides the following definition of accessory structure:
Unless otherwise specifically regulated elsewhere herein, a structure with a height greater than 4 feet that is subordinate in both purpose and size that is incidental to and customarily associated with any principal structure that is located on the same lot and detached from the principal structure.
Accessory structures are subject to limitations on height, setbacks, floor area, and separation from other structures that vary based on zoning district and lot size. See the table on the following page from Section 6.7.2.D. of the UDO for more information on how accessory structures in residential zoning districts are regulated. Playsets and playground equipment meeting the definition above are subject to these rules.
Proposed Text Change:
The intent of this text change is to exempt certain minor accessory structures from setbacks and permitting requirements. The list includes private recreational equipment such as playhouses, swing sets, and basketball goals; flagpoles; and mailboxes.
Public Meeting Schedule:
This text change is scheduled for a Planning Commission meeting on November 23, 2021. The Commission may act on that date or refer to their Text Change Committee for further discussion.
