What can I do on this page? 

 

Applicability: 

The complaint procedures apply to the beneficiaries of the MPO’s programs, activities, and services, including but not limited to the public, contractors, subcontractors, consultants, and other subrecipients of federal and state funds.

 

Eligibility: 

Any person or class of persons who believes that he/she has been subjected to discrimination or retaliation prohibited by any of the Civil Rights authorities, based upon race, color, sex, age, national origin, or disability may file a written complaint with Triangle West TPO's Title VI Coordinator.  The law prohibits intimidation or retaliation of any sort.  The complaint may be filed by the affected individual or a representative and must be done according to official Triangle West TPO policies.

 

Time Limit and Filing Options:

A complaint must be filed no later than 180 calendar days after the following:

  • The date of the alleged act of discrimination; or
  • The date when the person(s) became aware of the alleged discrimination; or
  • Where there has been a continuing course of conduct, the date on which that conduct was discontinued or the latest instance of the conduct.

The Title VI Complaint Process:

  1. INCIDENT/ISSUE: Complaint must be filed within 180 days of the incident.
  2. ACKNOWLEDGEMENT: Within days the TPO will mail an Acknowledgement letter and Complainant Consent/Release Form.
  3. CONSULTATION: The TPO will consult with NCDOT to determine the acceptability and jurisdiction of the complaint received.
  4. INFORMATION REQUEST: If the complaint is incomplete, the TPO will request additional information. The complainant will have 15 days to respond.
  5. INVESTIGATION: If the complaint is complete or additional information is received, the TPO will notify the complainant if an investigation is warranted. An investigation will follow if warranted and additional information may be required.
