The request from a residential district to a mixed-use district would permit commercial uses on the site. The request removes the Neighborhood Conservation Overlay District (NCOD) from the site. Removing the NCOD would allow greater height permitted height, 35’ under the NCOD compared to 50’ in an RX-3 district. Additionally, a request of RX-3 removing the NCOD would permit smaller minimum lot sizes and setback requirements. Proposed conditions would prohibit certain uses otherwise allowed in RX: detention center, jail, prison, and cemetery.  

Existing Zoning: Residential-10 with Neighborhood Conservation Overlay District - New Bern-Edenton (R-10 w/NCOD).  

Proposed Zoning: Residential Mixed Use, 3 Stories, Conditional Use (RX-3-CU). View proposed conditions here.
