New Bern Station Area Planning Rezoning (Z-92-22)
New Bern Station Area Planning Rezoning (Z-92-22)
If you would like to request your property to be removed or added to the request, please leave you name, property and state your request to have your property be removed or included in the request under the question that asks if you have any comments on the rezoning case.
The request would apply the Transit Overlay District (TOD) and change the base zoning, increase height, and change frontages for parcels on both sides of the New Bern Avenue Bus Rapid Transit route. The Transit Overlay District and zoning changes would encourage active, walkable, transit-oriented development near the future Bus Rapid Transit routes. Use the New Bern Station Area Planning Rezoning Viewer to search for a property address and see the proposed zoning changes.
Existing Zoning: Various zoning districts
Proposed Zoning: Various zoning districts (increase height, change base districts in some cases) with the Transit Overlay District (TOD)
- The TOD changes the zoning rules for development where it is applied. Below is a summary of the overlay district, and you may read the full text here.
- Prohibiting new car-oriented land uses like, car dealerships, car washes and repair, drive-thrus, and new low-density housing, like single family and duplex housing. However, existing uses may be maintained, repaired, rebuilt, and in some cases expanded.
- Applying a maximum of two parking spaces per residential dwelling unit.
- Allowing buildings to be taller if a portion of the additional space is used for guaranteed affordable housing units or if the building entirely contains places of employment.
- Requiring new buildings to have at least 2 stories and allowing residential areas to develop with smaller setbacks.
- Requiring an urban street and building frontage and applying the downtown plaza standards.
- Requiring tree conservation for sites greater than 4 acres instead of 2 acres and exempting development from aesthetic or perimeter buffer tree conservation requirements. Environmental tree conservation requirements would remain.
- Allowing commercial uses mid-block in Residential Mixed Use areas and removing maximum floor areas for commercial uses in Office Mixed Use and Residential Mixed Use areas.
