The request would rezone approximately 1.85 acres of land from Office Mixed Use, 3 Stories, with Neighborhood Conservation Overlay District (OX-3 w/NCOD) to Office Mixed Use, 4 Stories, Conditional Use (OX-4-CU). This rezoning would permit additional building height and remove the existing Neighborhood Conservation Overlay District (NCOD). The proposed conditions would prohibit several uses that are otherwise permitted in the OX- district, including cemeteries; outdoor sports or entertainment facilities (regardless of size); parking facilities; sports academies; detention centers, jails, or prisons; check cashing or payday loan establishments; tattoo parlors; taxidermists; and wedding chapels. The conditions would also require the property owner to document the existing building at 831 Wake Forest Road - such as through photographs and measurements - and submit that documentation to the Raleigh Historic Development Commission (RHDC) and the State Archives of North Carolina before applying for any building permit that would affect the structure.
